Terms of service

These cover the app and the optional remote-access service. They do not cover the monitor itself — that was a sale, it is yours, and no term here can take it back or switch it off.

What this covers

The Nimbus app, the optional account, and the remote-access service that lets you see readings when you are not on the same network as the device. Using any of the three means you accept these terms.

The monitor is a product you bought outright. Its sensors, its display, its local network features and its Matter and HomeKit support are functions of the hardware and continue to work whether or not you ever agree to anything on this page.

If the service ends

Companies fold and services get retired. If we withdraw the remote-access service, we will give twelve months’ notice by email and on this site, and the device will keep reading, displaying, alerting and reporting to your smart-home system exactly as before. Nothing bricks.

If Nimbus Instruments ceases trading, we have committed to publishing the local API specification and the last firmware image under a permissive licence so the device stays serviceable by someone else. That commitment is written into the company’s articles.

Availability

The remote-access service is free and provided as-is. We aim high but we do not offer a service level, and we will not pretend otherwise in order to look bigger than we are.

What you may do

Read the local endpoint as often as you like, from whatever you like. Log it, graph it, publish it, build a product on it. Take the device apart. Solder to it. Write your own firmware — opening the case voids the warranty on the carbon dioxide sensor for the reason given on the warranty page, but it is not a breach of anything.

What you may not do is resell access to our remote service, use it in a way that degrades it for other people, or present readings from a Nimbus device as certified measurements in a legal, regulatory or clinical context. This is a consumer instrument, not a reference one.

Liability

Nimbus One is not a life-safety device. It does not detect carbon monoxide, natural gas, radon or smoke, and it must not be relied on in place of an alarm that does. Fit the alarms your building requires.

Beyond that, our liability to you for the app and the service is limited to what you paid for the device. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Changes and law

We will email account holders at least thirty days before any change that reduces what you get, and post every version here with its date. Continuing to use the service after a change means you accept it; if you do not, delete the account and the device carries on locally. These terms are governed by the law of England and Wales, and nothing in them affects the statutory rights set out on the warranty page.
